Amendment to the Delegation of Powers, Duties and Functions of the Minister of Public Safety and Emergency Preparedness under the Customs Act

This document amends the Delegation of Powers, Duties and Functions of the Minister of Public Safety and Emergency Preparedness under the Customs Act Document signed on , and subsequently amended, as per the attached Schedule for the purpose of items 40(1), 40(2), 42.4(2), 43(1), 51(3), 59(1)(b) and 115(1).

The regional positions of Auditor, Senior Regional Auditor and Manager (CT-EAV-04) are added to the following delegations:

Customs Act reference Description of the authorities
40(1) Authority to designate a place where records are to be kept by importers for purposes of the Customs Act.
40(2) Authority to determine whether a person has complied with subsection 40(1) in respect of the records.
42.4(2) Authority to deny or withdraw the preferential tariff treatment under certain Free Trade Agreements.
43(1) Authority to require any person to provide any record at a specified place and within a reasonable time.
51(3) Authority to determine price per unit of the goods for purposes of calculating deductive value.
59(1)(b) Authority to further re-determine within a prescribed time frame other than four years.
115(1) Authority to make or cause to be made copies of records documents; and certify copies of records that are admissible as evidence.
